Sexual Assault

Our client and the complainant had been dating on-and-off for quite some time. After they broke up, the complainant was kind enough to still watch our client’s son while he was at work.

One day, the complainant called the police. In a flat-toned voice, she told the 911 operator that our client had just tried to rape her. The 911 call also recorded our client on the phone with the complainant’s current boyfriend. When the police arrived, our client was calmly waiting to explain what had happened – without a shirt on. Afterwards, the complainant told police how our client had raped her a few days before.

On both occasions, the complainant claimed she had been wildly biting our client in her own defence. However, no scratch or bite-marks were ever observed or photographed on our client. At trial, our client did not testify. The jury deliberated for less than four hours.

RESULT: Our client was found not guilty on all counts.
